1. Scope of Application

These Terms and Conditions (T&C) govern the use of the website https://out-fits.me/ (hereinafter referred to as “Outfits” or “Platform”), operated by Outfits, hereinafter referred to as “Operator,” and apply to all users of the Platform (hereinafter referred to as “Users”), regardless of their location. By accessing or using Outfits, Users agree to be bound by these T&C.

2. Description of the Platform

2.1 Outfits is an information platform that enables Users to browse products listed on third-party Chinese marketplaces, view Quality Control photos provided by shipping agents, and engage with a community of Users. Features of the Platform include, but are not limited to:

• Browsing and comparing product listings from third-party marketplaces
• Viewing Quality Control photos provided by shipping agents
• Creating user profiles and collections (spreadsheets) of saved products
• Writing reviews on products
• Posting outfits and commenting on other Users’ outfits
• Following other Users and sellers
• Viewing a personalized feed of activity from followed Users and sellers
• Receiving notifications when followed sellers list new products

2.2 The Operator does not sell, offer, or provide the products displayed on the Platform. All product listings and related information are sourced from third-party marketplaces and shipping agents. Outfits serves solely as a tool for accessing and presenting this information to an international audience.

3. No Verification or Guarantee

3.1 The Operator does not verify, authenticate, or guarantee the accuracy, authenticity, quality, or legality of any products, listings, or Quality Control photos displayed on the Platform.

3.2 Users acknowledge that the Operator has no control over the products, their availability, or the actions of third-party marketplaces or shipping agents. Any reliance on the information provided on Outfits is at the User’s own risk, regardless of the User’s location.

4. User Responsibilities

4.1 Users are responsible for their own decisions and actions based on the information provided on the Platform, including participation in the affiliate program.

4.2 Users agree not to misuse the Platform, including but not limited to scraping data, attempting to interfere with its functionality, or using it for unlawful purposes under applicable local or international laws.

5. User Content, Public Profiles, and Personalization

5.1 Users acknowledge and agree that their username, avatar, product spreadsheets, outfits, outfit comments, reviews, and any other content they create or upload on the Platform may be publicly visible and accessible to other Users and third parties. This content may be indexed by search engines and shared outside the Platform. Users are responsible for the information and content they choose to make public.

5.2 Users’ follow relationships (i.e., the Users and sellers they follow, and the Users who follow them) may be publicly visible on their profile. Activity such as saving products, posting outfits, and writing reviews may appear in the follow feeds of other Users who follow them.

5.3 The Operator collects and processes data related to Users’ interactions with the Platform, including browsing behavior, product views, and other usage data. This information is used to improve the Platform’s functionality, provide personalized recommendations, and enhance User experience. By using the Platform, Users consent to this data collection as described in the Privacy Policy.

5.4 Users understand that their avatars are publicly displayed alongside their usernames on the Platform and cannot be made private. However, Users may delete or replace their avatars at any time through their account settings.

6. Intellectual Property

6.1 The content, design, and structure of Outfits, including Ref Codes, are protected by copyright and other intellectual property laws. Users may not reproduce, distribute, or modify any part of the Platform without prior written consent from the Operator.

6.2 Product listings and Quality Control photos remain the property of the respective third-party marketplaces or shipping agents, as applicable.

7. Limitation of Liability

7.1 The Operator provides the Platform “as is” and does not warrant its uninterrupted availability, accuracy, or fitness for a particular purpose.

7.2 To the fullest extent permitted by law, the Operator shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use Outfits, including but not limited to losses related to product purchases, reliance on information displayed, or non-payment of affiliate commissions by shipping agents, regardless of the User’s jurisdiction.

7.3 Liability is limited to intent and gross negligence, in accordance with German law.

8. Third-Party Links

8.1 Outfits may contain links to third-party websites, such as Chinese marketplaces or shipping agent platforms. The Operator is not responsible for the content, availability, or practices of these external sites, including their affiliate programs.

8.2 Users access third-party websites at their own risk and are subject to the terms and conditions of those sites, which may differ from these T&C.

9. Privacy and Cookies

9.1 The collection and processing of personal data are governed by the Privacy Policy, and comply with the General Data Protection Regulation (GDPR) as applicable to an international user base.

9.2 The Platform uses cookies and similar tracking technologies. Essential cookies are necessary for the proper functioning of the Platform and are set automatically. 11. Governing Law and Jurisdiction

11.1 These T&C are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

11.2 For Users who are merchants, legal entities under public law, or have no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from or in connection with these T&C is Berlin, Germany. For all other Users, statutory jurisdiction rules apply, though German law remains governing.

11.3 Users located outside Germany acknowledge that the Platform is operated from Germany and agree to resolve disputes in accordance with German law, subject to mandatory local consumer protection laws that may apply in their jurisdiction.
